Navigate Property Debt with Kenya's Leading Recovery Specialists
Effective real estate collections in Kenya are crucial for maintaining the financial health of property developments and management companies. Unpaid service charges, defaulted land purchase installments, and rent arrears can cripple cash flow and stall projects. At Swipe Recoveries Experts Ltd, we provide a structured, legally compliant, and highly effective service designed to recover these specific debts. We understand the nuances of property law in Kenya and work diligently to secure your funds while preserving, where possible, the relationship between property owners and debtors. Our approach combines firm negotiation with a deep understanding of the legal avenues available, ensuring a recovery process that is both professional and results-driven for developers, landlords, and property managers across the country.
The Legal Framework for Real Estate Debt Recovery in Kenya
Recovering property-related debts in Kenya is governed by a specific set of statutes and legal precedents. For properties under a sectional title, the Sectional Properties Act, 2020 is paramount. This act empowers the Management Corporation to levy service charges and, crucially, provides a legal basis for their collection. The corporation can register a caution against a defaulting owner's unit title at the Land Registry and even has the power of sale to recover arrears, subject to following the correct legal procedure. All actions must be compliant with the resolutions passed by the corporation's members and documented in minutes.
For debts arising from sale agreements for land or off-plan properties, the Law of Contract Act (Cap 23) and the Land Act, 2012 are the guiding frameworks. The sale agreement itself is the primary document, and its clauses on default and remedies are what we enforce. Disputes and claims are typically filed at the Environment and Land Court (ELC), which has specific jurisdiction over such matters. Our team ensures that all demand letters, statutory notices, and court filings strictly adhere to the Civil Procedure Code to prevent technical dismissals and expedite the recovery process.

Our Proven Procedure for Real Estate Collections
Our recovery process is systematic and designed for maximum efficiency. It begins with a comprehensive review of all documentation to establish the validity and quantum of the debt. Key documents include the signed Sale/Lease Agreement, the Management Company's by-laws, official minutes resolving to collect, detailed statements of account, and any prior correspondence with the debtor.
Step 1: Formal Demand & Negotiation. We issue a formal demand letter on our letterhead, which immediately signals a serious intent to recover. This letter outlines the outstanding debt, cites the relevant legal agreements, and provides a clear deadline for payment. Our experienced negotiators then follow up to secure a payment plan or full settlement, saving clients time and litigation costs.
Step 2: Legal Action & Enforcement. If amicable settlement fails, we advise on and initiate legal proceedings in the appropriate forum, whether it's the Small Claims Court for smaller amounts or the Environment and Land Court for larger, more complex disputes. Once judgment is obtained, we proceed with enforcement actions, which can include attachment of salary, seizure and sale of movable assets, or placing restrictions on the property title to compel payment.

Transparent Fees & Cost Expectations (KES)

At Swipe Recoveries, we believe in transparent and performance-based pricing. Our primary fee structure for real estate collections is a commission on the amounts successfully recovered. This ensures our goals are perfectly aligned with yours. While each case is unique, our standard commission rates are typically structured as follows:
10% - 15% on successfully recovered service charge and rent arrears.
5% - 10% on successfully recovered land purchase installments, reflecting the higher value of these debts.
A nominal file opening and administration fee, starting from KES 15,000, may be applicable to cover initial costs like searches and formal demand notices. It is important to note that should legal action be necessary, court filing fees, which are prescribed by the judiciary and depend on the claim amount, and advocate's fees would be separate costs. We provide a clear and detailed cost estimate before commencing any litigation, ensuring you remain in full control of all expenses.
