Ensuring Procedural Fairness Across the Country
Effectively serving legal papers in Kenya is a fundamental pillar of the justice system, ensuring that all parties in a legal dispute are properly notified. This process, known as 'service of process', is a constitutional right and a mandatory procedural step for any court case to proceed. Swipe Recoveries Experts Ltd provides a reliable, professional, and nationwide process serving solution. Our network of licensed process servers operates in all major counties, from Nairobi and Mombasa to Kisumu and Eldoret, guaranteeing that your summons, plaints, and other court documents are served in strict compliance with Kenyan law. We manage the entire process, providing you with the critical Affidavit of Service needed to move your case forward.
The Rules of Service: The Civil Procedure Rules (Order 5)
The process of serving legal documents in Kenya is rigorously governed by Order 5 of the Civil Procedure Rules, 2010. These rules are not mere suggestions; they are mandatory requirements that protect the defendant's right to be heard. The primary method of service prescribed is personal service, where the process server physically hands the documents to the defendant. If the defendant is a corporation, the papers can be served on a director, secretary, or other principal officer at the registered office.
Our process servers, licensed by the High Court of Kenya, are experts in these rules. They understand the importance of making diligent attempts at personal service and documenting each attempt. If the defendant cannot be found or actively evades service, the law provides an alternative: substituted service. This requires a formal application to the court to request permission to serve the documents through other means, such as by advertising in a newspaper with national circulation (like the Kenya Gazette or The Daily Nation) or by affixing the documents to the defendant's last known address. Swipe Recoveries can manage this application process, ensuring your case is not delayed due to an elusive defendant.

How We Effect Service of Legal Papers Anywhere in Kenya
Our nationwide process serving is built on a seamless and accountable system. The procedure starts with document intake and verification at our Nairobi head office. You can deliver the documents to us physically or via a secure courier. Our team logs the documents, verifies they are complete (e.g., properly stamped by the court), and identifies the service location.
Next, we assign a local process server from our extensive national network. Having a local agent in the target county, be it Nakuru, Garissa, or Kakamega, is crucial for efficiency and cost-effectiveness. This server is equipped with all the case details and begins the process of locating the defendant to attempt personal service. All attempts, whether successful or not, are meticulously recorded with date, time, and observations.
Once service is effected, the process server prepares a detailed Affidavit of Service. This sworn statement outlines precisely how, when, where, and to whom the documents were served. It is then commissioned by a Commissioner for Oaths to become a legally binding document. We then return the original documents and the commissioned affidavit to you or your advocate, providing the irrefutable proof of service required by the Judiciary of Kenya to proceed with your case.
