Ensuring Timely and Verifiable Service of Process
A reliable civil process server is a critical link in the chain of justice, and Swipe Recoveries Experts Ltd provides the most dependable service in Nairobi. The success of any court case begins with the proper service of legal documents, such as summons and pleadings. Without valid service, a court cannot assume jurisdiction over a defendant, leading to costly delays or dismissal of the case. Based at International Life House on Mama Ngina Street, we are strategically positioned near the Milimani Law Courts to offer law firms, corporations, and individuals swift and effective service of process. We understand the high stakes involved and operate with a commitment to precision, speed, and providing legally indisputable proof of service through a formal Affidavit of Service.
Legal Mandate: The Civil Procedure Act & Rules

The function of a civil process server is formally defined and regulated by Kenya's Civil Procedure Act (Cap. 21) and the detailed Civil Procedure Rules, 2010. Specifically, Order 5 of the Rules outlines the mandatory procedures for the service of summons. It dictates how, when, and to whom legal documents must be delivered for service to be considered valid by the court. The primary method prescribed is personal service, where the documents are physically delivered to the defendant in person. The process server must make diligent efforts to effect personal service.
Should personal service prove impossible after multiple attempts, the Rules provide for substituted service. This requires an application to the court to allow service through alternative means, such as advertisement in a newspaper or by posting the documents at the defendant's last known address. Our expertise lies in understanding these nuances. We meticulously document every service attempt, providing the necessary evidence to support an application for substituted service if needed. Our deep familiarity with the requirements of the High Court of Kenya and various Magistrate's Courts ensures our service methods stand up to judicial scrutiny.
Our Process Serving Procedure: From Instruction to Affidavit
Our process is designed for efficiency and legal integrity. When you entrust Swipe Recoveries with your legal documents, we execute a clear, professional procedure.
1. Document Reception and Review: You can deliver documents to our office at International Life House or arrange for a pickup. We immediately review the summons and pleadings to ensure they are complete and court-stamped.
2. Attempting Personal Service: Our process server promptly proceeds to the address provided to attempt personal service on the named defendant or a recognized agent. We make several attempts at different times of the day if necessary.
3. Effecting Service: Upon locating the defendant, we serve the documents and request an acknowledgement of receipt by signing our copy. If the defendant refuses to sign, the server makes a note of the refusal, and the service is still considered valid.
4. Preparing the Affidavit of Service: This is the most crucial step. Our process server drafts a sworn legal document known as an Affidavit of Service. This affidavit details the date, time, location, and manner of service, and serves as the official proof to the court that the defendant has been legally notified of the suit. The affidavit is then commissioned by a Commissioner for Oaths.
5. Return of Service: We promptly return the commissioned Affidavit of Service and the acknowledged copy of the summons to you, ready for filing in the court registry.
