Specialized missing asset recovery is crucial when you suspect assets have been hidden, misappropriated, or are simply unaccounted for. From corporate fraud investigations to inheritance disputes, the process of identifying and reclaiming what is rightfully yours requires forensic expertise and legal acumen. Swipe Recoveries Experts Ltd, operating from our offices at International Life House on Mama Ngina Street, is a leader in asset search and recovery. We assist clients in uncovering a wide range of assets, including undeclared bank accounts, real estate, company shares, and other valuable property concealed by debtors or fraudulent parties. Our mission is to provide you with a clear, documented path to recovery, transforming uncertainty into tangible results.
Governing Laws for Asset Recovery in Kenya
The framework for missing asset recovery in Kenya is robust, drawing from several key pieces of legislation. A primary statute is the Proceeds of Crime and Anti-Money Laundering Act (POCAMLA), which establishes the Asset Recovery Agency (ARA) and provides mechanisms for tracing, freezing, and confiscating assets deemed to be proceeds of crime. While our work is often civil, the principles of POCAMLA inform the tracing process. For unclaimed financial assets, the Unclaimed Financial Assets Authority (UFAA), established under the Unclaimed Financial Assets Act, is a critical entity. We assist clients in searching the UFAA database and navigating the claims process for assets like dormant bank accounts, unclaimed dividends, and insurance policies.
Furthermore, the Companies Act and records from the Business Registration Service (BRS) are vital for uncovering corporate assets, shareholdings, and directorships. In cases of suspected corruption involving public officials, the Ethics and Anti-Corruption Commission (EACC) plays a central role. Our expertise lies in using legally permissible methods to gather intelligence that can be used in civil litigation to secure court orders, such as preservation or freezing orders, which are essential for preventing the disposal of assets before a final judgment is rendered. We ensure our investigations comply with the Data Protection Act, providing you with evidence that stands up to legal scrutiny.

Our Proven Asset Search and Recovery Procedure
Our approach to missing asset recovery is methodical and results-oriented, ensuring every possible avenue is explored.
Step 1: Case Evaluation and Strategy Development: We begin with a confidential consultation at our Nairobi office to understand the nature of your case, the suspected assets, and the parties involved. We review all existing documentation, such as loan agreements, court judgments, or partnership deeds, to establish the legal basis for the search.
Step 2: Forensic Investigation & Data Analysis: Our team conducts in-depth searches across multiple databases. This includes land registries, company registries (BRS), motor vehicle records (NTSA), and capital markets data from the Capital Markets Authority (CMA). We look for direct ownership, shell corporations, and transfers intended to conceal ownership. This phase may also involve lifestyle audits and analysis of financial records where legally permissible.
Step 3: Asset Verification and Valuation: Once potential assets are identified, we perform on-the-ground verification. For real estate, this includes site visits and valuation. For other assets, we confirm existence and current status. This step is crucial for building a strong case for recovery.
Step 4: Recovery Execution: Armed with verified information, we work with your legal counsel to take the necessary steps. This can range from initiating negotiations for settlement, applying for court-ordered injunctions to freeze the assets, to executing a judgment through attachment and auction. Our role is to provide the critical evidence that enables these legal actions.
Understanding the Costs of Missing Asset Recovery

The cost associated with missing asset recovery is directly related to the complexity, value, and location of the assets in question. At Swipe Recoveries Experts Ltd, we maintain a transparent fee structure so you can make an informed decision.
Our fee model typically consists of an initial Investigation and Search Fee. This retainer, which can range from KES 50,000 to KES 200,000 or more, covers the extensive forensic work, database access costs, and man-hours required for the initial search and verification phase. The exact amount is determined by the scope of the search—whether it is confined to Kenya or requires international tracing.
Upon successful identification and/or recovery of assets, a Contingency or Success Fee is charged. This is calculated as a percentage of the value of the recovered assets, typically ranging from 5% to 15%. This performance-based model ensures our interests are perfectly aligned with yours. We are driven to not just find the assets, but to see them successfully recovered. All fees are discussed and agreed upon in a formal engagement agreement before any work commences.
